Can I sell or evict my spouse? - Posted by wait146
Posted by wait146 on July 12, 2005 at 12:55:31:
The house is in my name only and was bought during the marriage. My husband refuses to pay any bills. He has not paid bills in about 2 years. He only wants to cut the grass and wash and wax is truck. We fuss and agree all the time. I moved out of the bedroom in March. He walks in and out of the house and acts like he is king. He does not want to go. Myself and our 15 year old son is frustrated with my husband. We both go to our rooms and shut our doors when he is in the house. They should give him a clue don’t you think! I went to court on June 23 for limited divorce and the judge stated that I did not have enought grounds for a divorce at this time. She also saide that t someone needs to leave the house. Can I force him out? Can I go to court and have him evicted from the house? Can I offer him 5,000 to see if this will make him go? I do plan to divorce him. Please reply.

they sure don’t make marriages like they used to. Have you talked to your husband about this whole thing? Shutting your door is not communicating, and if “frustration” was a grounds for divorce, none of us would be married. If I’m out of line, I apologize … but divorce is not fun and it shouldn’t be taken lightly.

Sounds like you need a divorce attorney to me. What state are you in?

I have talked to him many times. Even after we went to court for the limited divorce. He wants us to fix up the house a little more to sell it in about a year and half. Also, he wants to collect as much money from the house as he can ( this is what he said!) Once we do that we both can go our separate ways. He is not considering our 15 year old son who has 2 more years in school. His response to that was “it will not hurt him to start a new school”. He is only thinking about money. I can not see myself living with him another year and a half.

I am in the state of Maryland. I had a divorce lawyer on June 23. She went for the grounds of cruelty and the judge through the case out. Basically not enough evidence.

I’m sorry to hear your husband is being this way. I know this is a tough time, but I pray that you and your son will find a better situation for yourselves. I don’t know what to tell you about the eviction, but I wish you the best.

I wish I could answer your question assertively, but I really have no knowledge in this area.
What did your attorney advise you to do? If she wont give you any further advice, its time to get a new attorney.
I never knew that it was hard to get a divorce.
How are you holding title to the property? Is it just you on the title?
