If I refer a person to a realtor is there any way to capture a referral fee? What if I was a realtor and referred to another realtor outside of my geographic area? Could I then legally capture a referral fee or a commission?

Actually the answer to this varies state to state.

In WA State,recently the RE Commission ruled that a lic. agent or broker can share his paid comm. with anybody he/she might like. Once it’s paid, it’s the agent’s to do with as he/she pleases.

This probably hasn’t been ruled on or decreed in all states, and one might find instances where an agent had done so and been penalized for sharing fees with non licensee.

State to state RE agent to RE agent referrals and fee or comm. splitting is very common and to my knowledge, all states RE Commissions honor fee/comm. splitting & sharing with other, but out-of-state licensees, on the basis of legal reciprocity.
