I agree with Rick. It sounds like a kickback to me and kickbacks are prohibited by Section 8 of RESPA. For anyone to “earn” a fee they must perform certain duties that have been approved by HUD as duties that have value.

It depends, if they just referred someone then the answer is no. But if they did some other activities in regards to the transaction that permits them to collect a fee from the transaction, then yes. To complex to answer here in a short answer. Why do you ask?
