So many questions that I suspect nobody’s going to want to undertake answering them all here.

I’d suggest you get the free IRS publications on SDIRA investing (IRS Pub. 590), also 401k, and they’ll likely answer most of your queries…also maybe a book or two on “qualified plan” RE investing to educate yourself on self dealing, illegal dealings, etc.

A recent Fed decision on self dealing that you should familiarize yourself with is Swanson vs. Commissioner, 106 US Tax Court 76, a '96 decision. You can find this on Google.

And the big 3 (Pensco, Entrust, Equity Trust) self directed IRA trustee companies have websites with Q&A sections to answer a lot of your questions.

Lets say Mr. Smith has several properties he trades on buys and sells quickly etc… however, say also Mr. Smith likes a particular property to keep ! Under what circumstances can he have enjoyment of the property now? Lease to an entity he controls? Lease to a Trust that he controls? Lease to a relative? who understands the situation with the understanding that the owner may make whatever improvements he likes during the lease? Please advise on this !
