If you have no signed contract or buyer broker agreement between you then you could cut the broker out but if he has put things together for you he will have a case, especially if he has documented this fact proving that he is involved in the deal. The broker also may have supplied this fact to the seller or the title company where you will be closing too. Be careful.

I am a buyer and in the middle of contract to close on a residential property in CA.

Is it possible to change broker’s without the consent of the existing broker? There is no buyer broker contract to bind us.

Any insight would be helpful.

If you have signed a valid agreement then it is binding. You should consult a real estate attorney before you end up paying double commissions.

Why are you wanting to change brokers? Did your broker do all of the leg work in putting you and the seller together on this purchase? If so, your broker has records that would attest to this and he/she will earn a selling commission, even if you decide to switch. In addition, generally the real estate contract will reflect the commission the selling broker is to collect.

The issue is that there is no agreement nothing was ever discussed or documented, but is there an implied contract/agreement.

No actually my wife and I did all the legwork to find the property.

We even made an offer with no agent. The seller and seller’s agent did not feel comfortable with us not being represented. So we found representation thru a relative.

The agent(the relative) is willing to give most of his commission to us but the broker had a complicated arrangement depending on who we find financing thru. The agent has told me repeatedly that the broker hasn’t done anything on this transaction.

Now it looks like his financing avenue is pretty poor. I found another broker who is willing to do the deal regardless of who we do financing thru.

I’m interested in feedback.

Are you talking about a Real Estate Broker or a Mortgage Broker?
