Breaching a Contract - Posted by Daniel Flores

Goes to motivation. Why would you do this? Is one buyers money greener than the other?

We investors are in this to make profit and live a lifestyle of our chosing. Buying low and selling higher is one way we do it. Buyers, Sellers, and Properties come and go, we can’t get hung up on any of them, in the end it is the profit we seek.

I believe the lawsuit you would face could be such a costly expense, that you would regret ever trying this in the first place.

If I(seller) want to breach a contract so I can sell a property to another party for the same price, what are my options. And if i breach the contract and go ahead and sell to the new buyer, what is the general precedence if the original buyer wants to sue?

Daniel

In my state I’ve never know a buyer to lose a specific performance lawsuit in these cases. Plus you will have to deal with buyer #2 when they get upset, at not getting the house, etc.

I hate this, because I just want to be ugly to people that try to cheat others. What is the reason for doing this? Why did you sign a contract in the first place? How would you like it if someone did this to you? Do you have no values?
