Wait until June 30th to get paid. If payment is not due until then, there is no breach. I would imagine that you have a mechanic’s lien on the house. So if she doesn’t pay you by the end of June, you can sue her for breach at that point. With the mechanics Lien, at least she will not be able to re-fi or sell without paying you.

I am in Texas and I have a contract to build a home for a lady. I am almost finished. She still has not got financed to pay me back. My contract says that I must be paid in full by June 30, 2004. What should I do?
