Hello,

I recently purchased a house with my girl friend and bought the house with both our names on the deed. I put up all the down payment and the loan for the house is in my name entirely.

Is there any method to removing her name from the deed as we have broken up and she will not sign a quit claim deed?

I made a huge mistake in the purchase and want to know if there is any recourse now to correct it.

Yes, you could file a Partition Suit which would be expensive but would result in court ordering sale and split of proceeds after payment of loans.

I’ve settled a couple of these for myself and friends, over the years, by sending a copy of a proposed lawsuit petition/complaint to the other party with a letter that if he/she doesn’t cooperate, I will file it and put the whole mess in the hands of the court…and with a proposal that we amicably do the splitting now, outside of court and without the expense of lawyers.

Recommend you try the same, even if you have to hire a lawyer to draft the Partition Action, without having the lawyer file it until later on, if ever.

You cannot unilaterally remove her from title. If she will let you buy her interest, go for it. If not, see if she will agree to sell the property to a third party, so both of you can start over. If not, you may have to force a judicially-supervised partition sale. This is expensive.
