A tenant files a bankruptcy. The annual lease expired prior to the filing. She is now on a month to month. We have accepted no rent. Is the next step a relief of stay? Should I consult the bankruptcy trustee?
It’s not that I don’t want to use a lawyer it’s that I want to make sure whoever I hire knows what to do. Believe it when I tell you competent, affordable legal help is hard to come by.

What are you trying to do? Why wouldn’t you accept the rent? If they are current, and can pay, why would you want to get rid of them just because they filed for BK? If they are in arrears, and you are trying to evict them, I believe you would need to file a motion for relief. Even if it’s difficult to find, you need an attorney experienced in dealing with the bankruptcy system to guide you through this, if it’s your first time.

BK has nothing to do with month to month tennancy. If she does not pay rent she needs to move.
