I took a business law class a couple of years ago in Texas. The instructor was a lawyer who also volunteered for a little league group. Several times a season a foul ball would damage a car in the parking lot and the owner would threaten to sue. According to him the little league was not responsible because the driver willfully and knowingly placed their property at risk by parking near the field

I moved a mobile home onto my property in TX in 1996. At that time there was an existing baseball field behind my home. This year I moved a 2000 sq ft frame home onto the property which is sitting further back ,closer the to the baseball field. The problem is now I am getting baseballs in my yard ( they came over with the mobile home as well, but were never close enough to do damamge)that can potenitally break windows ( $150 each plus installation)or hurt myself or my husband/ foster children. I spoke with the president of the (non profit) organization and he stated that they do have insurance, but that his attorney advised him that since I moved there with the baseball park in existance that they are not liable for any damages the balls cause or just their existance in my yard. Netting would cost me $300 and they do not want to take on that expense either. What are my rights in Texas? Thank you.
