I am purchasing a home that currently has several liens against the husband who passed away ten years ago. In NJ (where the property is located) married couples take title as tenants in entirety by default if the deed does not specify otherwise. This deal is very tight and eliminating the payoff of these liens would go a long way to satisfying the sellers.
Will the title company require the liens be satisfied, and if so, is there any other recouse?
