Thanks John. My listing agent is the RE broker. The property consisted of a house and in excess of 50 acres. Sold to a developer with family ties and possibly financial ties (business partners)to my broker.

I recently sold a second home in New York. I believe my agent has a business relationship with the buyer and disclosed information which I told him about prior to the second offer which I ultimately accepted. Is this a conflict of interest? What is my recourse if any?

What do you mean “your” agent?

Was he your Listing Agent, which would have made him your agent, under law, with fiduciary duty to you?

Or was he the buyer’s agent who found the house for the buyer?

If he was your listing agent, then I’d go have a talk with his RE Broker who’s responsible for all agents in his office and tell him all about this.

If he did violate your confidence by telling the buyer inside or confidential info, then yes, he was guilty of a conflict of interest.

His RE Broker and the State RE Commission should know about any such conflict so they might take action against that agent.
