Hello.

Got a couple of questions… Here is my situation. My parents own a house, it is under both my parents name. My dad passed away 3 years ago.

The house’s mortgage is paid off.

  1. Does my mom now own 100% of the house? I just not 100% sure.

  2. The property tax bill is still under both my parents names, I am helping my mom paying property taxes now. But since my name isn’t under the house deed, i am not eligible for property tax break. My mom was thinking adding my name to the deeds, will I then be eligible for tax break? I am currently at 15% tax bracket.
    Also my mom is 52 and whose income is only $6000/year. Can she claim herself as my dependant?

  3. I live in Long Island, NY, does anyone know where can i go to add a name to the deeds? Do i need a lawyer?

My wife mother passed away and her father is 74 and is not in good health and we want to add her to the deed of her fathers house. They live in Hernando counth Florida

I have been married to Richard Smith for 6 years. We have lived in his home. Now he would like to put my name on the Deed so I would be protected in case of his death. Can we do this without the expense of a lawyer?

Get a lawyer.

When your dad died, was there a will, and did it go thru probate?? Did he leave all of his interest to your mom??

As to your mom deeding you part of the house, there’s gift issues involved.

Then, don’t try to write up a deed and file it yourself, if don’t know how to write one up, and don’t know the answers to the above questions.

If your husband was qualified, and got a mortgage before you married, then adding your name to the deed would have no effect as he will still be responsible for the loan on the property, as his name would still be on the mortgage regardless of what the deed says.

So I wouldn’t worry about your not having a job as it will have no bearing on the situation.

I would consult an attorney though. My sister bought a condo in her own name before she remarried. She had since added her husbands name to the deed.

She consulted an attorney and went through the issues involved in remarrying, prenups etc. Her case is more complicated as he has a son by a prior marraige, and she has two daughters plus grandchildren by her prior marriage.
