I would post this in the cash flow section and see if David or Michael can answer your question. They are the owner financing experts regardless if SFR or commercial properties.

I sold a commercial property and business and took a second deed of trust.The buyer refinanced the 1st mortgage with a new deed of trust,dated after my 2nd.I was not informed nor asked to subordinate.I can find nothing in my contract allowing them to do this with me remaining in a second position.My lawyer does not usually deal in commercial real estate so can anyone out there tell me if I am now the holder in 1st place ?Thanks for asap answer as forclosure may be forthcoming.
