First, I am not an attorney, although sometimes I feel like we do need Dr. Phil on this board.
Why is it that you would pay for a home inspection and then ignore what the inspector put on the report? Especially something like water in the basement!! The reason for the home inspection is to uncover anything that the seller did not disclose or have knowledge of.
You have no way of knowing that the seller knew about the water in the basement. The seller may not have gone into the basement often, or even after it rained. Your state laws may cover seller disclosures and home inspections. The inspection company might be able to point you in the direction of the state laws, if there are any.
Don’t get your hopes up. You ignored the inspection report. There are some things that people can ignore in inspection reports, like trimming the outside Cedar trees (this was put on an inspection report of my home), however, water in the basement should not have been ignored.
It’s kind of like the story of the man sitting on top of his house in a flood. The rescue team came by boat and he refused rescue. Later they came by helicopter and he refused them again. He eventually drowned and wet to heaven and asked God why he let him die and God said, I sent you a boat and a helicopter, what more could I have done?
I wish you luck on getting this resolved, although I do not believe the seller is responsible when you ignored the inspection report.
