US Court Restitution Lien - Posted by Joe H

I’d go up to the Fed Distr. Clerk’s office and look at the paperwork on this lien and that might tell you all you need to know.

If not, I’d suggest you go by the US District Attorneys office and see if you could talk to one of the assistant DAs there as he/she’s likely familiar with this lien and its characteristics.

Like all other judgments I’d presume that it comes (in priority) after the 1st & 2d (& 3d & 4th mtgs)and likely behind the other J’s too.

From what you say about that soon-to-be-ex-homeowner, his being in the Fed Jug is way past due.

US Court Restitution Lien - Posted by Joe H

Hello everyone. I am working on a foreclosure that has multiple mortages (4) and judgements (8) against it.

The house is in Okla. and is worth $800K. The other leins and judgements total $1.2M (working on getting these released)

The 1st & 2nd mortgage holders have filed foreclosure cases.

The owner is in federal prison for securities fraud and the US Federal Court has just filed a $1M restitution lien against the property.

My question is where does this lien take priority? First? Last? Do they have a right of redemption like the IRS? How long does this lien last?

Thanks for your help.
