Be smart, don’t deal with that co. unarmed. Have your lawyer make contact with them, and insist that the co. deal with him/her only.

And if you’re called again by them, tell them that your lawyer (whose name you can’t remember, as he’s just one of the 100+ lawyers in that big office bldg down town) told you not to talk to the pest any more.

I once was moving a dead bug (VW) and because it had no lights, parked it overnight in a closed gas station’s overhang…and sure enough, Murphy being alive and well, that gas station operator drove by after it closed, got angry when he saw my bug and pushed it out onto street.

From the curb where he’d re-parked it, the E Brake being defective, )along with most everything else on it), the Bug took off downhill on its own journey of destruction and managed to do a lot of damage to a bunch of parked cars.

So, very early the next AM, I got a threatening phone call from some insurance adjuster, re MY alleged liability to his insureds…thankfully I was awake just enough that I parried him and told him I’d have to check into it and I’d get back to him.

Fortunately I made no agreements to pay anything, as all the liability ended up on the GS operator, as he was the dummy who parked my wild bug on the street and was responsible for its erratic journey.

I’ve found that most phone threats of lawsuits, prosecutions, etc. have a way of evaporating. And promises by the victim, made in an effort to mollify the pests, are frequently regretted in hindsight.

The title company that closed on our previous home called three weeks after the closing telling me that they put the wrong payoff amount in our documnt file. The sent a letter demanding the difference, and included a bunch of threatening legal terms.

We put all of the proceeds of our previous sale into our new home. We were excited that we thought we had some additional money and ued a portion of this windfall to purchase new furnishings for the new home.

What is my obligation to the title company. What is their obligation to me in regards to this mistake.

I’d bet that one of the title companies documents that you signed was a payoff agreement that obligated you to come up with any shortage of the payoff. Additionally, you seemed to have known of the “windfall”, yet purchased furniture and put some of the proceeds into your new house anyways, so you won’t get any pity from me or many others on this issue. Also, it’s your debt, in your name, so I don’t think avoiding it is going to help your credit one bit.

You should see an attorney.
