A couple in California would have had a great view in the hills if it were not for their neighbors trees. They dispatched a single tree(without permission) and lost a court decision for $25,000.00 plus they had to replant an equivalent tree in the neighbors yard. But that’s Cali.

Hi,
We have a house on a wooded half acre. The lot next to us was completely wooded. Yesterday, a company came in to start clearing it. We told the owner of the company that the small chicken wire fence that devides the properties is actually three feet into our property and that they should not clear any tree that belong to us. The owner agreed. Well, sure enough today they cleared every tree up to the fence, including five full-grown palm trees! We have a survey to prove where the property lines are. Can anyone please recommend a course of action to take? Is this serious enough to warrant hiring an attorney? Can I put a lien on their property and force them to replant the trees or get some restitution?

Slow down before you go the lawyer route. You’ve been damaged, the question is HOW MUCH. Attorney’s cost $175/up per hour. On a lot your size the only way to know how much you’ve been damaged is for two appraisals, one with those trees (type, caliber-diameter and heighth) in place, and another without them.
Go and talk to the owner first, see what you can work out, on a lot of that size your damages is mainly aesthetic. In hindsight hanging around and watching them would have prevented this, but you can’t should have after the fact.
Remember when dealing with other people and other owners, most people are MORONS, except those on this site!
