Either husband or wife obtain the special power of attorney from the daughter in advance (only the notarized signature from the daughter is required on the special power of attorney. She can prepare it at where she lives and mail/overnight it to the parent.), and sign on behalf for her on the closing.

The special power of attorney letter should contain the daughter’s name, the appointee (husband or wife), and the address of the property. Ask for the specifc requiremnts to the escrow/title company or the closing lawyer.

I have approval from a lender for a short sale. The sellers are husband and wife, and daughter. All three names are on the deed. Is there a way to close on this if the daughter refuses to come to the closing? Would a Quit claim deed work? Even if they are in foreclosure?
