Just curiosu. What grounds are you going to use to file the lawsuit. You seem to have been put on both actual and constructive notice that the proerty has a faulty heating system.

What is the seller doing that is grounds for your proposed laswuit?

Cavet Emptor…would surely be a factor here.

I was told by a real estate agent that a seller cannot sell a home in the state of
California without heat. I am currently attempting to buy such a home and the
seller will not credit back the cost to fix the problem. The seller says he will
take the property off of the market before he credits back the cost to fix it. Is
it possible to persue the seller after the home closes to recoup the cost for
the heating system? Please advise. Thanks.

You think you can FORCE the seller into putting in some heaters just for you?

Nonsense!

He’s got the right to sell it as-is, without a roof or windows if that’s his choice.

And if you don’t want it on those terms, don’t buy it.

This is still the US of A, thank God, and no gummint has the right to tell us how we have to sell our property.

Do you want the deal? Is is in fact a “deal”? How much to put in a heat system? Wall units are pretty cheap and very effective except in the Sierras.

If the answer is a number that doesn’t break the deal for you, just do it. If it’s not, walk. If he wants to sell it he’ll come around.

Worthless to go after him after close, the old “bird in the hand versus one who has flown away” adage.

BTW, I’m pretty sure your agent is full of cr**. Ask her to reference a specific part of the property code.
