Depends on what the law says in your state.
In my state if the seller knew of the defect or concealed the defect and failed to disclose then the seller can be held liable up to 1 year after closing.
The key is you have to prove the seller knew of the defect or tried to conceal it. If the seller had no knowledge of it then they did nothing wrong.
You have to read up on what the law says for your state and what the statue of limitation is to file a claim.
