I agree with BTI … if it is a probate situation, all the kids have equal rights to the property … so the deal must be done with all. One thing you might also do is figure out who has been paying the property taxes … that is the person I would start with …

About a year ago I located a prop. that needed probated. I have been in contact with one of the sons that lives local and he says he is interested in selling but he will not let me get the ball rolling. I have offered to do everything necessary, from dealing with lawyers to filing for the state tax release. He keeps insisting he has a friend that can do it and he wants her to handle the situation. This has gone on for a year. I do not waste a lot of time on him, but I do drop by every once and a while to see if he has done anything. ANY!!!..suggestions to help me motivate this guy to get on the stick. By the way tonight I visited him and he said he has been sick for a couple of months and has lost 30lbs. If I were to guess I would say he may not have much time. We negotiated a price that would net me 25k so I think it is worth getting done. Thanks for your input.

Is he the executor of the estate? (or personal representative, or whatever your state calls that person)

Trying to motivate someone to be a motivated seller is a losing proposition.

Like the other advise here, I’d say find who the person in charge of the property is and deal with that person.

Follow up, but don’t try to motivate anyone, it is always a bad idea.

Dealing with one of the sons? Forget him for now, find the other sons, etc. and get the story, at this point you don’t even know if he has any ownership or any interest in, or rights in the property. I’m sure he enjoys jerking you around though.
