I own approx. 60 acres in Texas that the only way I can get to it is through someone elses property. He has locked the gate and refusses to issue me a key or let me accsess my property. Is this legal for him to do?
If not can you get me in the general direction of where I can look this up in writing.

Go to your local recorder’s office and ask someone to assist you and check for easement for access. If others have been using it before you bought it should be recorded somewhere and he cannot deny you acess.
Also look at your title insurance policy…it should be stated there.
Good Luck,

Bill H thanks for the information. The property in question has been in our family for over 100 years and we have been useing the same access gate for at least 50 years. Does that make a difference?

Ingress/egress/easements, etc are a thing of their own and I’m not an attorney and cannot give legal advice. However, it wold certainly look to me like you have established a precedent.
Exactly what is the problem? Is the guy mad at you for some reason. Can you find out what the burr under his saddle is? That seems to me to be the best way.
If you wind up in court the only ones who will win will be the attorneys and they get paid regardless of the outcome on eithr side.
Try and find ou WHY he decided to lock the gate?
Good LUck,
Bill H
