The landlord was remodeling as we were moving in. We’ve lived here a month and he has not finished the repairs needed…i.e. electrical, heating, countertops…etc. There are numerous holes in the house where we are losing heat out of, such as broken window, dryer vent (open to outside), and electrical outlets. Anyways…I was wondering if there is anything I can do to make him do the repairs promptly. Can I withhold rent? Or even pay someone to make the repairs and give him a bill for it? Also our heat bill is going to be outrageous because of the holes leaking heat out, so can I make him pay half? We have contacted him numerous times about this and he gives us the run around and maintains that he will fix it but is always too busy. Thanks. Sorry this is so long…lol

My state has a statute that covers this type of issue. Basically in my state you would need to give the Landlord a 14 day written notice regarding the repairs. Send it certified. If he fails to comply with this notice in my state you may make a deduction of rent provided it does not exceed a certain percentage, and provided you have paid rent for a certain number of months prior to this.

Every state is different. You need to check out your landlord tenant law. Tenants have rights. To make sure you’re on correct legal ground you should consult an attorney.

you need to come to grips with reality. You people are always looking for a way to not pay the rent. You all probably haven’t even tried to contact the owner. You probably insisted on moving in before the work was done and the landlord was just trying to help you. Now it’s all his fault because you are a chill baby and got the heat turned up to 85 degrees. Take the initiative and get of the couch and fix the stuff yourself. How’s he gunna get in there when you’re out shopping with those credit cards you can’t seem to put down because “you deserve those things”. But you can’t pay the rent.

Ok, sorry… Let me rephrase this… Can I have the repairs done myself and take it off the rent? Some of the stuff I can live with , but when it costs me money (high heat bills) because my heat is going out the broken window, the dryer vent, and numerous holes in the house. I need to draw the line. I do not want to cheat him out of any money… I just need some things fixed. I’ve asked him if I can hire it out and even did my homework and called contractors and did get some estimates for the major repairs (broken window, dryer vent, electrical, ect…) and some were pretty reasonable, but he says he’ll do it himself. Then I don’t hear from him again.I just think this is crap! I will pay my rent for April… On time… I just don’t think this is right! And I will continue to pay my rent until I can fiqure something out or find another place to live. I really like my house and don’t want to move, it just needs some work (that was promised before I moved in) I would of never rented this place in the shape it’s in.I told him that when I looked at the place… He assured me these things were going to be fixed! He said he would “never” let anyone live in these circumstances. I trusted him… what can I say? I had to move in because I had already given my old landlord my thirty day notce and my time was up. “Landlord” or “tenant”… people are people! “Everyone” deserves a fair shake!!! I try to be as fair as I can to people, you know “do unto others” I make this part of every day life. Ijust wish everyone else felt the same! Especially my landlord! He’s not a bad person… I just think maybee he needs a little push… that’s all I was looking for here, something to get him motivated. Whithout everyone getting all nasty!
