Hi all,

I just dissolved out of a business partnership. My partner wanted to buy my other 50% ownership, so created a Note & Deed of Trust on his property. I needed to protect myself just in case he did not pay my loan that I gave him. I just wanted to be able to place a lien in the case that he decided not the pay my debt.

My questions is:
What do I need to do to record the Note & Deed of Trust?

In my area the DOT is recorded, but the note is not. You should consider having an attorney draw up the docs for you.

You can do a google search for the name such as “Contra Costa County Recorder” and look through the list for the one in your state. The website will usually explain where to send the documents and how much fee to include.

in some florida closings, the title cos use a mortgage and note that are combined and therefore record both. Personally I don’t like any note I sign to be recorded because it reveals the interest rate. However, All these “investors” who entered adjustable mortgages during the boom, don’t realize that in almost all the riders to such mortgages, the interest rate, both initial and adjustments, are revealed to anyone who knows their way around finding public records.
