Actually, putting “this contract shall not be recorded” in big letters is a SURE way for the buyer to record it. Having done well over 200 CFD closings, I can tell you that 99% of buyer don’t think about recording, because they don’t know.

Simple ways to prevent recording are outlined in my “Alternative Real Estate Financing Course,” including not having a notary acknowledgement. Also, some state, like Maryland REQUIRE recording.

If i sell on a contract for deed is there any way to insure it can’t be recorded? I would make sure that it wasn’t notarized and possibly put some type of clause in bold print, i.e. this contract shall not be recorded.
