I’m not a lawyer, but I don’t see any obligation to pay the Realtor. IF he takes you to small claims court (which I doubt), go see his BROKER and explain that YOU are out much more in additional rent and moving expenses due to acting on REPRESENTATIONS made by the agent.

Tell the broker that you will dedicate yourself to “word of mouth” advertising the incompetence and “lack of broker supervision” from his office and that everyone in town will know of it within 30 days if the agent brings suit in small claims.

I will try to make it short: The buyers of our house went past the closing date on the contract. Our realtor didn?t have an answer as to why. We had gone through getting the appraisal and home inspection and fixed what they buyers wanted fixed. We had moved out into an apartment. 30 days past the closing date, still no answers. Our realtor said buyer was still interested, but had changed lending institutions. Our realtor said he would ask for additional earnest money. We were coming up on having to pay another mortgage payment, in addition to the rent of our apartment. The realtor gave us the payment stating that he would get it from the buyer. We understood this to mean that this was the additional earnest money. Due to issues we had with the realtor, we fired him and that same day learned that the buyer did not get financing. We received a check for the original earnest money with no note or communication from the realtor, just the check. Now the realtor is asking for the money he ?lent? us to pay our mortgage or he will take us to small claims court. Are we obligated to pay him?
