It sounds like you have only used the home in the summers since 1992. If that is the case, I would think you’d have a difficult time claiming that the home was your “primary residence” for two out of the last five years, given that you spent only 25% of the year there.

Am I eligible to benefit from the real estate capital gains tax when selling my california home, given that I am currently non-resident alien but all my children are USA citizen and were born while we living in this home while working in the USA? I bought a home first in california in 1977 for the purpose of using it as my primary resdicence in USA. Later I sold it and bought another in 1988. I spent time working at a california University in 1978 and again 87-89 and 90 and 92. We used the home also every summer in other years.
