What name did your friend purchase the property under?

What name is your friend using in the lawsuit?

Is it possible your friend is suing under the name of a different entity than the one they used to purchase the property?

Is it possible that your friend is using the name of a company that is not registered with the State Corporation Commission?

Just some ideas.

I have a friend who bought a property that turned out to be more or less a junk anyway he now sued the seller to reimburse him for the repairs since it wasnt “as it is” sale anyway, the seller’s lawyer now sent out “an answer to complaint” and in the letter; it says d defendant(seller) made some denials and affirmative defenses which includes:
** Plantiff(buyer) does not have capacity to sue or be sued
** Plantiff does not have legal existence.
