Another good reason to have a home inspected immediately after signing a purchase offer on a home. You should also have asked for a septic inspection. I would suggest contacting a real estate attorney in your area. The attorney will need to see your purchase agreement and all addendums and the closing papers. Good luck.

we have now owned our home for 4 wks where the sellers had marked, on the property disclosure stmnt, there were NO problems with the septic system or sewer sytm and that there IS a leach field. our neighbors, along with the sanitation pumping company who has taken care of the property’s septic tank pumping for four years, have told us that there has been problems with the sewer system for a long time and that there is no leach field. We have methane gas in the house. we had the tank pumped 2 wks ago, it’s now full again. the bathroom sits right on top of the septic tank. we took off the toilet last night to find that the tank is full - we have capped the hole - temporarily. my question, do we have recourse since the sellers knew that the problem existed. lastly, is there a law that says the sellers have to have the tank pumped and inspected before closing the sale.
