Another example of why Condo’s are a pain in the arse. Contact the mortgage company and tell them since theyl own it or will own it they need to do something about it or legal action will be taken.

First, I am a condominium owner of a refurbished aparment building. I have been experiencing periodic leaks from the unit upstairs . Such as leaks in my bathroom, kitchen and living room ( I also discovered a small amount of mold in the closet as well). I spoke to the property manager and during his inspection he noted that the upstairs condominium would be responsible for the damages. However I was also informed that I would have to resolve the issue with the tenant myself. At the same time, they would try to contact them as well to notify the tenant that they are aware of the complaint.Unfortunately I discovered today that the tenent is now in forclosure of the home and a morgage company now has ownership of the property. Who is responsible for the property damage now?

Try to convenience your tenant and make him aware of the property damage. Otherwise you can proceed legally
