Local title co. title examiner could answer your specific question about the POA in question, as to whether it would pass their muster or not, whether that Atty in Fact per that POA could deed, etc.

While they’re no more amenable than any of the rest of us as to giving specific legal advice, they are normally cooperative and will quickly tell you if they see any problem areas ,on passing a title, that concern them.

When Jane Doe, daughter and POA for her elderly (incompetent) mother wishes to deed the house, what is the best way for it to appear?

Something like "This Deed made between Jane Doe, as power of attorney for Martha Doe, Grantor, and (insert name of Grantee here), Grantee…?

Are there any other issues I should be aware of? (Yes she actually does have power of atty, I’ve seen the docs.)
