I was told that someone can start and run a for sale by owner real estate business without being licensed. Lets say I wanted to start my own business operating a FSBO site of some kind. I would be marketing properties. In essence helping people sell their homes. In New York would I need to be a licensed broker for this? I would appreciate any info. Thanks.

It is not that difficult or expensive to obtain a real estate license.

The problem comes in when you are charging people money to sell their houses. “commissions”. What happens when a transaction goes wrong…

Johnny,

I’m not an attorney and not familiar with NY law. Most FSBO businesses are not engaged in brokerage activities. That’s what you need a license for. If you are just selling signs and advertising medium, you’re really not providing brokerage services.

You should check into this carefully since the National Association of Realtors has been known to go after businesses who don’t use the traditional RE model. They will do whatever it takes to ensure that consumers have to pay money to Realtors.
