New Real Estate Cap & Trade Law - Posted by Rob

I would like to know how we as investors will or can get around the section of the cap and trade section dealing with selling a home.

If we buy a home that is in distress for a great price. How do we take ownership when all the Cap and trade items are not completed. Yes we could not file new ownership with the county. This is just some of the questions that are bugging me on this. That is an issue by it self.

If you have not heard about this here is what I know. The walls and roof have to have a correct insluation value. Correct paint has to be on the walls. All house lighting needs to be up to the cap and trade specks and the cap and trade inspector needs to sign off on this that it conforms

Current status of this legislation? - Posted by John Merchant

As best I could determine from a short Google search this is not yet law as only one house has passed it.

Of course the press is doing its best to make us all believe it’s already a done deal so we can go back to sleep and not worry about what the left is doing to us.

Anybody have any more current info on present status?

first, we are talking about a HR bill passed by a thin margin. The HR can pass anything they want, even banning Christmas and anointing Obama the second coming of Christ. the House is almost always going to be more conservative or more liberal than the country at large, and the federal body politic in specific. its the nature of the game, with individual districts, and gerrymandering of district line-drawing. both parties do it, so I’m not being partisan. as a result, California produces some of the most radical librals and also, ironically, the most radical conservatives (remember B-1 Bob Dornan?). Texas does the opposite (compare Tom Delay with Sheila Jackson Lee—possibly one of the most breathtakingly stupid human beings ever elected to public office)

the Senate will not pass this bill, and it will most likely die in committee. expect fierce objection from all but two Senate Republicans, and a hoard of Dems as well. Both Dems from WV will vote against (coal mining), as will both from Arkansas, Nelson from Florida and possibly both from Colorado (hard coal mining is a big deal in CO). and lets not forget our buddy in Alaska (Begich) who got his position thanks to a liberal media parade and crooked prosecutors (as you recall, the convictions were thrown out and the prosecutors publicly flogged by the appeals court----unfortunately after the 2008 elections).

Can you cite this law? State or federal?

It’s the cap and trade bill…sections 201-219 deal with energy efficiency. Section 201 deals with building codes and 202 deals with retrofitting.

This is what has passed in the House in D.C. When they come back from the 4 of July break, the Senate will be making their version.

I don’t expect much to change on the portion for home investors.

When this is all done. We will have to deal with a Federal inspector every time we buy or sell a home.
