I just closed on a property three days ago. I received a deed with a “Schedule A” attached to it. The “Schedule A” is the legal description of the property that was sold to me. Today I re-examined the “Schedule A”, and discovered that it contains this clause: (Bear in mind my Seller is Owner No. 3):
“BEING the same premises conveyed to OWNER_2 by deed of OWNER_1, dated January 1, 1990”
The problem is that the above is language from the deed which OWNER_2 gave to my current seller who is OWNER_3.
My seller should have given me a Deed with a clause that reads
“BEING the same premises conveyed to OWNER_3 by deed of OWNER_2, dated April 29, 2005”
I think the deed has been recorded. I dont know what to do?
What can I do about this?
