Thanks for the reply. The legal description says only 1 lot which we thought the whole property was, but its two lots enclosed in a fenced yard. We didn’t give it a second thought, the lot in question is smaller but apart of our enclosed yard, maybe even going into a workshop,garage area. All previous owners have own both lots.

My mom purchased a house from hud, a foreclosure property. We found out later that the property is really on 2 lots. One is still in the previous owner name. The company selling the house for Hud said there was nothing they could do. We went back to the people who sold the house to the man and got all the proof the house was sold to the man with 2 lots. What happen was escrow rewarded the man 1 lot, caught their error a couple months later and then proceeded to award him the 2 lot. So, when Hud got it , it showed only the 1 lot, what a mess. The property is all enclosed in a fence yard. We will see if a real estate attorney can help, anybody think we have a good chance of getting the lot back. We haven’t tried contacting the owner because he might try to cause us problems. Thanks, in advance, for any responses.

I am not an attorney. It sounds like maybe there was an error in the legal description of the property.
Did you get a survey and title insurance?
If so, contact the title insurance company. They should handle this for you.
