I’m short-saling a house from Countrywide, but the ex-husband (gone two years now) had and has judgments. It appears she got title to the house as part of the divorce decree, and then refi’d. Did that wipe his judgments off the title, or will I need him to sign off too, since they were married when the house was originally bought 7 years ago? Seems like the bank wouldn’t have written the loan if the judgments still encumbered the title. I don’t want this deal to get too complicated.

Sometime the J isn’t recorded so it doesn’t become a recorded lien against any property.
I’ve known of lazy lawyers who didn’t record when they should have, also clients who were advised by their lawyers to “go record it” but didn’t…so for whatever reason it just doesn’t get recorded and doesn’t become lien against RE.
