I bought some land with my dad about 9 years ago. we split the down paymeny and he helped me with the first 8 months of payments and stoped. Since he has not helped with anything. He is in bankruptcy chp 13 and while he listed it as an asset and had it put outside the plan he still wont pay his share. He has two months left in his plan and im affraid he will file on me if i wait to long. I just had the mortgage reaffirmed and had to get him to sighn but he still will not pay, instead he say since we have only 40 months left “out of 12 years” he wants me to pay the first 20 then he will pay. And while i dont think its fair. There is another problem. I have a brother that is been wanting this property for years and has said that he would one day get it. The point is he probally will since my dad has no WILL and he is in bad health. and i dont want to have paid all this and my brother that lives at home 3x wives,11 kids and has never worked a day in his life get his hands on the land. Also my dad has never made any improvements on the place. I built a house on the place. I guess what i want is to know is . Is there some way i can protect my property. Please let me know what i need to do and can you help me.

The key will be how the property is titled. Tenants in Common, Joint Tenancy, etc …
How is the property titled?
