Does your contract read that the owner can decide whether or not s/he is agreeable to “fix” the items listed in the inspection? Or does the contract indicate that the inspection must be to your satisfaction? Do you have a date in the contract that indicates when the homeowner must accept the findings of the inspection report?

I just went through this same thing with a house I was selling. The buyer had a home inspection done. The inspector came up with some off the wall items, like trimming one of the shrubs on the side of the house. Of course, we rejected it. We had a reason for the size of the shrub. It was to hide a trash can. We had three days to respond to the inspection report as to what we were willing to do or not to do. Hopefully your contract indicates a time frame.

I signend two weeks ago a binding contract to purchase a house…per my realtor request I gave 500.00 as deposit, with the contingency that if the house do not pass inspection to my satisfaction, I could cancel contract and get my money back. The contract states the purchase as is if the amount is higher than 0, I do not have to purchase the home. At the day of inspection the owner refuses to turn the water on, because he did not wanted to pay the deposit. when the inspector shows up to the house, the house did had water, but the washer plumbing hook up, was broken, the electrical outlet for the fridge was connected wrong, there were electrical cable hanging, the roof that was supposely new, had nails sticking up, like it was not well done…and others, therefore he could not check the plumbing, the fridge, and obviously the roof was not correctly done. Per my realtor he asked to signed a document requesting the other party to released from the contract, which I am no longer interested to buy, and 4 days later, my realtor indicates that he does not have a answer yet from the home owner. I wan my money back, and continue foward with purchasing another property. Is this going to delay me or prohibit from me to get another home, until the other party decides to let me go?? what should I do?? Please advise…
