Mother left Massachusetts property from living estate as inheritance to five adult children, placing all five names on deed as tenants in common. One of the five, who also happens to be on the premises, refuses to sign Purchase and Sale agreement. Several attempts to negotiate were in vain. Unfortunately, this is not as simple as being a money issue. What recourse is there to force a sale?

Contact a Reat Estate Attorney in that area where the house is located. He may advise you to initiate a “partition lawsuit” where kid #5 is forced to sell.

Are there any reasons, other than out of the ordinary, that a partition lawsuit would not succeed in forcing a sale?
