my property went into foreclosure in California. The mortgage broker that originally got me a loan at 13%. Due to illness I couldn’t make the payments and my condo went into foreclosure. The mortgage broker said he would sell it for me as he had a buyer. There apparently was no buyer and my condo was forclosed on. The mortgage broker had apparently put a lien on my condo months before the foreclose in the amount of $75,000. which I never received. He then picked up my condo for what was past due and now owns it. He now wants me out of the property immediately. How long do I have before he will evict me. Thanks.

You’re way late in trying to learn your rights, but please find and see a lawyer asap.

If you’re in tough financial shape (no $$$) then find your local Bar Ass’ns Legal Aid office and go there.

If the mtg broker put a deed of trust on your house then either you signed it, or somebody forged your name so I’d have a title co. pull that and print it for you so you can see who signed it.

BUT, fyi, once a foreclosure is over, you need to get out without further ado.

The auction buyer could just have the sheriff knock on your door, order you out and haul your stuff to the street, but you have enough sense to not force that buyer to do that.
