John Boy has it going on. Get a pit bull or some kind of dog that will cause havoc to the cats. Or, move out and rent your half of the house to someone else. Rent it to someone who either plays the drums or the trumpet!!

I own a home with my boyfriend. The problem is that there are 2 cats that live in the house that are basically killing my health and well-being, and jeopardizing my health and my career. I have severe asthma and insomnia due to my allergies to these cats. My boyfriend refuses to move them out. I need to leave, and will have to find an apartment and will not pay for my mortgage as that would be unfair for me and financially impossible. I don’t want to ruin my credit, but find myself in a situation where it is me or the cats, and he has chosen the cats. If the cats were gone, my problems would disappear. Do I have any legal action against him? How can I protect my credit?

Go buy yourself a big mean pitbull and let it run loose in the house. Your cat problem should be resolved real soon! If your boyfriend has a problem with your new pitbull then tell him to move out because you choose the pitbull over him!
Doesn’t he have a job or ever leave the house? Why not just pick up the cats when he is not home and take them to the pound or drop them off about 50 miles away and let them go.
BTW, your problems sound more severe than just getting rid of the cats. It sounds like you have bigger problems with the boyfriend if he chooses cats over you. Maybe you should find a new boyfriend and have him move in with you and share your half of the house. Then tell your old boyfriend if he doesn’t like it he can just move out with his cats! But your new boyfriend is staying!
Or perhaps you could tell your boyfriend you are going to rent out your half of the house to cover your mortgage payment and you will get an apartment. If he doesn’t like who you rent to, too bad!

Try leaving the door open at night, maybe they will just “go away.” Seriously though, if you can’t talk him into getting rid of the cats, then leaving sounds like your choice. If you are a tenant in common with your boyfriend, you are still obligated to pay half the mortgage whether or not you live there. However, he would need to initiate an action to recover this against you. As long as he keeps paying the mortgage, then your credit won’t be affected. I doubt he wants to screw up his credit either. You simply need to make sure he pays the mortgage on time every month and your credit should be fine.
If you simply want out of the house, have him buy out your interest, or sell it to a third party. If neither of those work, you could always fiel a partition action, but that gets expensive.
Moral of the story, never, ever buy a house with a boyfriend/girfriend. More often then not, it just leads to problems down the road. Perhaps, consider this one of those life lessons.
