No, the girl is paying the rent, she has the past two months…the thing is, she is NOT on the lease, he is. I’m just wondering if I can terminate the lease with him…and how I go about it. My thinking is if I just sign a new one with her, he could say I had no right to terminate, because he really hasnt moved out, since his belongings are still there, and he has been helping the girl with the rent.

ok…I have tenants, young couple with kids, but not married…they moved in, in July…have paid rent every month, late a couple times…the girl just called me, said that husband has moved out, and does not intend to return, however, would continute to pay 1/2 rent as form of child support…here is my dilemma…I have no problem with the girl and her kids staying there, as long as the rent is paid, but, I do not want to have anybody on the lease, that is not living there…How do I get him off the lease?? Would I have to get some kind of signed agreement with him??..my lease covers “Abandonment”…but, thats not really what this is…Any advice would be appreciated.

I’m not an attorney, but I would leave him on there so that they’re both still responsible for paying you.

Is he on the lease now? If so HE owes the rent! If your lease if properly written they have joint and several liability.

Face it any guy who abandons his girl friend and kids, with no word to his landlord is NOT going to pay, don’t hold your breath waiting on either of them to pay you.
