What is involved in foreclosing on a delinquent MH buyer in Ohio? Is it done thru small claims court? How do you file, what’s the cost, etc? Any info would be appreciated.

p.s.–In Indiana you don’t need a lawyer to file in small claims, just in civil court. I don’t use civil court unless they owe more than $ 3000.

You should be able to go to the courthouse and find out what filing papers you need. In Indiana we need to file in small claims for possession of the home or lot, and the judge will give them 15 days to vacant and decide on money due. Its simple and the only delay is getting a court date set. Just file a copy of your contracts with the court papers. Good luck.

I have no idea what the particulars of the process in OH (I’m from MO), but my first suggestion would be to go to the the small claims court in the County where the MH is located. Ask the clerk there what the process is. I had to do that here and all they would tell me is that it had to be done w/ an attorney. They did give me the name of an attorney they recommened, but that’s all they would tell me. Anyway, I called the attorney (several in fact) and had a hard time even getting any to talk to me to make an appointment. Finally found one through a recommendation from my accountant. By this time I had worked out the situation w/ my buyer, but I’m still having him review all my paperwork nonetheless. And now I know where to go next time, too.
