the main purpose that I have seen lands trusts used for is blind ownership, so you never want to sign anything personally.

The Trustee of the trust is the entity that sould be signing, sueing, evicting, etc.

I am the beneficary of my Landtrusts and have signed all the leases for my rental property. My son is the Trustee. I need to evict a Tenant. Do I put the name of the Landtrust and my Trustee on the eviction papers? and/or myself? Can I just go to court without my Trustee and represent myself/landtrust sinse I signed the Lease and I am the beneficiary? Any help would be appreciated.

I’m not a lawyer, but here is what I do. If you signed the lease, you have to sign the eviction.

When you have your properties in land trusts, you need to have the trust hire an agent to manage the rentals. That manager can be you (since you have some ownership, its perfectly legal.) You sign an agreement with the land trust. Now, on your lease paperwork, you sign: your name, as agent. This is great for a couple of reasons: you don’t get the hassles from tenants as much because you can tell them your just the manager. It works like a charm . . . your never the bad guy: the ‘owners’ are. Plus, tenants cant put you on the spot with their excuses about why they cant pay. Its not your house:)

On this deal you currently have, you will have to be the person on the eviction, since you signed the lease.
