Eviction after trustee sale - Posted by David

What most folks do is go see them or hire some one to go see them and offer them cash to get out in a short timeframe. I am sure there is some legal process, someone you can hire to toss them out, But you might want to go over, tell them you work for the new owner and offer them $500 cash if they get out by Sunday night. (or maybe next Sunday as this is Friday) Tell them you will come back to check on Monday morning and if they are out, will meet them in a public place (their place of employment, courthouse steps, in front of the library, not your house or your place of employment) and give them the money. If they don’t get out, then you can go to the next step. They are trespassing. Real estate agents who list REO’s for banks do this all the time. Good luck.

Does anyone have experience evicting a trustor after the sale? If so, what was the process? We are in Arizona.

Thanks.

David,

In most states, they will be considered a holdover tenant. You will probably have to follow the regular eviction laws that are used for regular tenants.

You held the deed of trust and they know it’s you. Probably ticked off at you if that is the case. Here is a link to Arizona Revised Statutes, might give you a clue. Might still want to buy them off.

Huge amounts of good luck to you.
