eviction a sec5 tenant - Posted by eric rice

I’ve kicked tenants out because they have failed to provide renter’s insurance like the lease says they will obtain.

True story.

Just don’t expect the judge to be your best friend after that. lol

eviction a sec5 tenant - Posted by eric rice

I have a tenant that has a low rent for our area ($800)normal rent is at least $1200. she is on sect.8 I offered her $200. to move she said “heck yes” she said that she cant until sect.8 approves. Sect.8 made us write letter to one other sign them and then turn in the sign letters to them. then they said when until the end of the lease. now they wont let her move without losing her sect.8. I need to get her out so, I can fix that place up, then i can raise rent or, even sell the place for a nice profit. How can i go about getting sect.8 to let this tenant move without losing her sec 8? thank for everyones help in advance!!!

Sue for possession of the unit - Posted by DJ-nyc

eric,

You may be bound to your state/county eviction laws. You may have to contact an attorney for your area.

In nyc, if it is 1 or 2 family you can do a “holdover” which sues the tenant for “possession” of the unit. You tell them/the judge I have to sell the place or whatever reason you choose. After the sec8 tenant gets the eviction papers he/she takes the papers to section8 worker who then gives them a new “voucher” to find another place. I believe different areas have different processes for handling these cases.

If she has a valid lease, you may have to find a violation of that lease to get them out. Check your state laws or a lawyer.

Good luck,
