Its better to sell the entire property since she says she wants her equity out and selling an interest would have to be heavily discounted.

I own a house with my ex-boyfriend and when we split up I wanted to be nice and help him get back on his feet financially, so I did not make an issue out of it right away. He is still living there and over the past couple years has almost let the house go into foreclosure. This has been terrible for my credit because my name is still on the title. Can I legally force the sale of the house and get my 50% of the equity and have my name removed from the title? I just want it to be over, but I don’t want to give up the equity I am entitled to.

You can file a partition lawsuit to force division of the property title so you can sell your half without his consent.

She doesn’t have to bring a partition action to sell her interest- she can sell her interest anytime- if she can find a buyer. She can bring a partition action to force a sale of the property.
