Unless your offer was in writing and the sellers had signed a contract with you, you are out of luck. All RE transactions, to be legal, must be in writing.

I was the first to see a property, asked to put a copntract on it and the couple said no that I would definitely have 1st chance. Met 2 days later with purchase agreement in hand but a Realtor was behind me and offered more money. The couple still said I would have first chance and they would call me that evening to get my “first chance”. An hour later I went back and they sold it to the Realtor. I have 3 witnesses who heard the owners say I had first chance. Do I have a lawsuit?

If S’s agent told you that, then you might have an actionable complaint against that agent and his/her broker…if he/she made a representation upon which you relied to your detriment or damage.

But, as you’ve been told, the S would have no obligation to you sans a written contract.
