I am about to buy a property from my neighbor. During the title search it was discovered that the deed is in her former married name. Her ex-husband is not on the deed and they have been divorced for 18 years. Her current husband is also not on the deed and is currently in jail facing a very long prison sentence. She wants to sell the property to finance a simple divorce. Is the deed being in her former married name going to be a problem? Other than that, the title is clean.

She signs Sally Smith, formerly Sally Brown. In N.C. have to get new
husband’s signature too.

I would not believe it would be a problem she may need to show a birth certificate to verify her identity.
The title company should be able to address this easily as to her maiden name…
